Privacy policy effective December 10, 2018
This privacy policy describes the personal data collected, used, shared or processed when you use Bertram’s websites, including when you visit or make a purchase from shopbertramgear.com or shop-bertram.myshopify.com (“Sites”). It also explains how your personal data is used, shared and protected, what choices you have relating to your personal data, and how you can contact us.
PERSONAL INFORMATION WE COLLECT
When you visit the Sites, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Sites, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Sites, and information about how you interact with the Sites. We refer to this automatically-collected information as “Device Information”.
We ask you for certain personal data to provide you with the products or services you request. For example, when you make purchases, contact our consumer services, request to receive communications, create an account, participate in our events, or use our Sites.
This personal data includes your:

We collect Device Information using the following technologies:

- “Log files” track actions occurring on the Sites, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
- “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Sites.
When you make a purchase or attempt to make a purchase through the Sites, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers and information on any other payment types accepted), email address, and phone number. We refer to this information as “Order Information”.
Third parties may also collect information via Sites through cookies, third party plug-ins and widgets. These third parties collect data directly from your web browser and the processing of this data is subject to their own privacy policies.
When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.
HOW DO WE USE YOUR PERSONAL INFORMATION?
We use the Order Information that we collect generally to fulfill any orders placed through the Sites (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
- Communicate with you;
- Screen our orders for potential risk or fraud; and
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Sites (for example, by generating analytics about how our customers browse and interact with the Sites, and to assess the success of our marketing and advertising campaigns).
We use the personal data you provide to us to operate our business. For example, when you make a purchase, we use that information for accounting, audits and other internal functions. We may use personal data about how you use our products and services to enhance your user experience and to help us diagnose technical and service problems and administer our Sites.
We may also use your personal data in other ways and will provide specific notice at the time of collection and obtain your consent where necessary.
SHARING YOUR PERSONAL INFORMATION
We share your Personal Information with third parties to help us use your Personal Information, as described above. Third party service providers may process personal data on our behalf, for example to process credit cards and payments, shipping and deliveries, host, manage and service our data, distribute emails, research and analysis, advertising, analytics, manage brand and product promotions as well as administering certain services and features.
We may share your Personal Information with other third parties to the extent necessary to: (i) comply with a government request, a court order or applicable law; (ii) prevent illegal uses of our Sites or violations of our Sites’ Terms of Use and our policies; (iii) defend ourselves against third party claims; (iv) assist in fraud prevention or investigation (e.g., counterfeiting); and (v) to otherwise protect our rights.
We may also transfer personal data we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, spin-off, dissolution or liquidation).

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. You have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.
Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Sites), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.
DATA RETENTION

Retention of your Personal Information: we retain your personal data for as long as necessary to fulfil the purposes described in this policy, unless otherwise required by law. For example, we keep your account profile information for as long as you keep your account, but, we may keep your order history longer to comply with legal obligations.
CHANGES
Applicable law and our practices change over time. We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. We strongly encourage you to read our privacy policy and keep yourself informed of our practices.
